2. Services Description
Z-Axis Manufacturing provides custom 3D printing services. We manufacture parts based on digital files (STL format) provided by customers. All orders are custom-made to specification and are non-returnable except as specified in our Refund Policy.
3. Intellectual Property Rights
Your Content
You retain all ownership rights to the 3D model files and designs you upload. By uploading files, you grant us a limited license to use, reproduce, and modify your designs solely for the purpose of fulfilling your order.
Your Warranties
You warrant that:
- You own or have the right to use all designs you submit
- Your designs do not infringe on any third-party intellectual property rights
- Your designs do not violate any laws or regulations
- You will not use our services to create illegal items, weapons, or prohibited goods
Our Commitment
We will not reproduce, share, or use your designs for any purpose other than fulfilling your order without your explicit permission. We treat all customer designs as confidential.
4. Prohibited Uses
You may not use our services to create:
- Weapons, firearms, or firearm components
- Items that infringe on intellectual property rights
- Illegal drugs or drug paraphernalia
- Counterfeit goods or currency
- Items intended to harm others or violate laws
- Adult content or obscene materials
We reserve the right to refuse service for any order we deem inappropriate or illegal.
5. Pricing and Payment
Prices are calculated based on material usage, print time, and complexity. All prices are in USD and must be paid in full before production begins.
Payment is processed securely through Stripe. We do not store your payment information.
Quotes are valid for 4 hours. After this time, you may need to request a new quote as material costs and availability may change.
6. Sales Tax
Sales tax will be calculated and added to your order total at checkout based on your shipping address and applicable state and local tax rates.
Tax Collection
We are required to collect sales tax for orders shipped to addresses in California. Tax rates vary by location and are determined by state and local regulations.
Displayed Prices
All prices displayed on our website are exclusive of sales tax unless otherwise stated. The final price including applicable taxes will be shown during checkout before you complete your purchase.
Tax-Exempt Orders
If you are tax-exempt (such as a registered reseller or non-profit organization), please contact us at info@zaxismanufacturing.com before placing your order. You will need to provide valid tax exemption documentation.
Out-of-State Orders
For orders shipped outside of California, you may be responsible for use tax or other taxes in your jurisdiction. Please consult with your local tax authority regarding your tax obligations.
7. Production and Delivery
Production Timeline
We aim to begin production within 24 hours of payment and complete most orders within 3-5 business days. Complex or large orders may require additional time. We will notify you if delays occur.
Shipping
Standard shipping takes 3-5 business days within the United States. We are not responsible for shipping delays caused by carriers. Local pickup is available in Orange County, California.
Risk of Loss
Risk of loss and title for items pass to you upon delivery to the shipping carrier.
8. Quality and Specifications
We strive to produce high-quality parts that match your specifications. However, 3D printing has inherent limitations:
- Minor variations in dimensions (±0.5mm tolerance is standard)
- Visible layer lines depending on print settings
- Color variations between batches of filament
- Surface finish may vary based on material and orientation
Parts are suitable for prototyping, testing, and non-critical applications unless otherwise specified and agreed upon in writing.
9. Limitation of Liability
IMPORTANT: PLEASE READ CAREFULLY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any structural failures, defects, or performance issues of printed parts
- We are not responsible for the suitability of parts for any particular purpose
- We are not liable for consequential, indirect, incidental, or punitive damages
- Our total liability is limited to the amount you paid for the specific order
- Parts are provided "as-is" without warranties of merchantability or fitness for purpose
You are responsible for validating that parts meet your requirements and are suitable for your intended use. We strongly recommend testing and validation before using parts in critical applications.
10. Indemnification
You agree to indemnify and hold harmless Z-Axis Manufacturing from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms of Service
- Your infringement of any intellectual property rights
- Your use of our printed parts
- Any illegal or prohibited use of our services
11. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Dispute Resolution Process
Before filing any legal action, you agree to first contact us at info@zaxismanufacturing.com to attempt to resolve the dispute informally. Most disputes can be resolved through communication.
Jurisdiction
Any legal action must be brought in the state or federal courts located in Orange County, California. You consent to the exclusive jurisdiction of these courts.
12. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes constitutes acceptance of the modified terms.
13. Termination
We reserve the right to refuse service or terminate your access to our services at any time for any reason, including violation of these Terms of Service.
